TROUSSELIER TERMS & CONDITIONS 

These terms and conditions of sale operate between the following parties :

and Internet major users who wish to make a purchase on the www.trousselier.fr or www.trousselier.paris website (sole property)

These terms and conditions aim at defining the obligations of the parties to each other, and the various stages in the ordering process.

1. CONTRACT

These terms and conditions govern the sale of any product displayed on the www.trousselier.fr or www.trousselier.paris (together www.trousselier.fr) website by the TROUSSELIER S.A.S. company.


TROUSSELIER S.A.S. reserve the right to modify the sales conditions. Ever since, it is agreed that the conditions applied are those in force on the website when signing the contract.


The parties agree that their relations will be exclusively governed by this contract, to the exclusion of any other terms. The items offered for sale may not be re-sold in any way.

Any order duly confirmed on the www.trousselier.fr website implies complete and unreserved acceptance of these general terms and conditions of sale.

, particularly when accepting the order.

2. PRODUCTS

The products shown on the website www.trousselier.fr are available while stocks last. Consequently, under no circumstances can TROUSSELIER S.A.S. guarantee to keep products on sale for a given period. Any customer’s complaint over the ordering or delivery of an unavailable item will be deemed unfounded. In such circumstances, TROUSSELIER S.A.S. undertake to notify, by e-mail or telephone, any customer who has placed an order for an unavailable item.

The products on sale are described and displayed with the greatest possible accuracy.

However, if any errors or omissions have occurred regarding this display, TROUSSELIER S.A.S. cannot be held liable. The product illustrations and pictures supporting the text do not enter the contractual field.

3. ORDER PROCESS 

The customer must follow the order process

  1.        Product selection: the client selects a product.
  2.        Verification of the selection’s content: he checks his cart’s content while retaining the option to remove the products he selected.
  3.        Identification: the customer has to fill in the identification form and give the requested information (obligatory information: civility, first name, last name,  address, birth date, e-mail, password, telephone number for delivery)
  4.        Order’s verification: the customer checks his order’s content, the total price, delivery and invoice addresses while retaining the option to remove a product or change the invoice and delivery addresses. He chooses his method of payment and must confirm his agreement of these terms of use by ticking the corresponding box. The order’s validation is possible only after this box has been checked.
  5.        Return on the SPPLUS’ s website (Caisse Epargne) for secure payment (SSL): the customer must indicate the bank’s details for the payment.
  6.        To acknowledge receipt: the client receives an email summarizing the order:
    - purchase order reference
    - ordered products list
    - delivery details.

It is recommended to keep and print this document, official proof of the order. The order is then registered and processed by TROUSSELIER S.A.S. which check the ordered product (s) availability. Spent orders imply the acceptance of the prices and the products’ descriptions available for sale. TROUSSELIER S.A.S agree to fulfill the orders received on their site within the limits of available stocks.
If the ordered products were not available, TROUSSELIER S.A.S will contact the customer by e-mail as soon as possible, in order to let him know about the order’s cancellation or refund.

  1.        The order’s delivery confirmation : TROUSSELIER S.A.S. acknowledge receipt of the order by sending an e-mail, once it has been confirmed. The confirmation email constitutes the sale and is irrevocably binding both parties.

4. PRICES

All prices are quoted in euros. VAT included is French VAT; it’s charged at the effect rate when ordering.

These changes may affect the prices of the items without the customer receiving any prior notice. 

All prices are exclusive of transport costs. These ones will have to acknowledged by the buyers on the summary screen before the order’s final validation.

Regarding VAT : 

- Delivery in Metropolitan France and countries from the EU: Prices are inclusive of VAT (VAT applicable)

Overseas departments and countries out of EU : The buyer will be responsible for clearing the goods through customs by paying the appropriate customs duties and taxes.

Ordered products will remain the property of TROUSSELIER  S.A.S. until TROUSSELIER  S.A.S. have received full payment.

5. DELIVERY

IMPORTANT: Our e-shop is closed during Christmas time. You can still place an online order. You’ll be delivered at the beginning of 2017. Thank You and Happy New Year! 

5.1. GENERAL POINTS

The products for sale on www.trousselier.fr may only be delivered to customer’s delivery address.

5.2. DELIVERY METHOD

All orders placed are prepared within an average 72 working hours from the order confirmation notified by mail by TROUSSELIER S.A.S. to the client. 

They are dispatched via Colissimo or Chronopost (trackable parcel service run by the French Post Office).

Order is hand delivered and against signature.

In terms of absence or inability to hand over the parcel, the postman leaves a delivery note mentioning date and post office address where to collect the parcel against presentation of ID.

There is a 10 days delay to collect the parcel.

 5.3. DELIVERY AND FEES

Times of delivery apply when customer receives from TROUSSELIER an advise of dispatch.

(1) Shipping costs will be notified by email by trousselier.paris from case to case please contact us : infos@trousselier.fr. As a matter of fact, Shipping cost depend on the weight of the order, that is why they can vary according to the content of a shopping cart. The amounts of the shipping cost posted on the Website are to be regarded as a deposit. In case of disagreement,  the customer will be repaid in full. 

The buyer will be responsible for clearing goods through customs and paying the appropriate customs duties and taxes.

 TROUSSELIER do not deliver P.O.boxes. 

 Delivery delays are given as an indication and are submitted to the product’s availability.

The deadline’s extension does not allow any order’s cancellation, nor discount on the paid price by the buyer or payment for damages. However and according to the consumer code article L.121-20-3, lack of delivery after a thirty days delay (starting from the day after the order has been place), the customer will have the possibility to cancel his order free of charges.

Customer will be refund.

If possible, TROUSSELIER SAS. will offer a quality product with same value to the original product. 

TROUSSELIER S.A.S. will not be held responsible for any additional delays due to incomplete order form or unattainable authorization from credit card companies or banks. 

 In case of partial delivery, shipping costs will only be charged on the first delivery. 

 The products are insured by TROUSSELIER S.A.S till the delivery.

 5.4 ITEMS’RECEIPT AND CLAIM 

Concerning the receipt of the parcel, TROUSSELIER S.A.S. strongly recommend the customer to check the goods’ shape. Customer will have to : :

  •          note discrepancies such as damaged packaging, missing or damaged goods on the bill of delivery
  •          send under registered mail under 48 hours after the delivery a reserve statement to the carrier
  •          forward a copy of this letter to the customer service

If in doubt, customer should open the parcel in presence of the carrier to make sure goods are not damaged. No claim can be made towards TROUSSELIER S.A.S. when this action has not been made.

6. PAYMENTS

The customer can pay directly through the website using a credit card Visa, Eurocard, Mastercard.or Paypal. 

Payment methods such as bank transfer or payment on delivery are not accepted.

The invoice amount will be debited from the customer’s account on the payment date.

To offer payment security, the www.trousselier.fr website use the SP PLUS secure payment system. This service complies with the 3Dsecure standard. Confidential information (the 16-digit credit card number, the expiry date and the visible security code) is transmitted directly in encrypted form to the SP PLUS server without passing through the physical media of the www.trousselier.fr server. 

When the order is confirmed, the payment request is routed in real time to the secure electronic payment system which sends an authorization request to the credit card network. The electronic payment system delivers an electronic certificate. 
For any credit card payment, the electronic certificate delivered by the electronic payment system constitutes proof of the amount and date of the transaction, in accordance with the provisions of article 1316 and those following it in the French Civil Code. In this respect, the date and time of the server shall be authentic evidence between parties. 
In all cases, confirmation of the order implies signature and express acceptance of all the transactions made on the website.

www.trousselier.fr keep the right to refuse an order if a further dispute in process exists or an abnormal high level order.

7. ORDER WITHDRAWAL POLICY

The purchaser has a 14 day period to exercise his right of withdrawal. Accordingly, the purchaser can ask for the item or items purchased to be exchanged or refunded within a 14-day period following the day when goods were delivered. Beyond that 14-day period, TROUSSELIER S.A.S. shall be free to refuse exchange, take back, or refund of the goods. The exchange or refund process is as follows:

1 – The purchaser must inform TROUSSELIER with his wish to withdraw within a period of 14 days following receipt of his order. The purchaser will load a withdrawal form on the website : www.trousselier.fr
2 – TROUSSELIER shall acknowledge receipt of the withdrawal as soon as advised.
3 – The purchaser shall complete the return slip combine to the purchases, specifying whether they want an exchange or a refund for each item.
4 – The purchaser shall return the item or items as well as the duly completed return slip via registered mail or parcel to the following address: TROUSSELIER 23, avenue des Prés 94260 Fresnes, France – within a maximum period of 14 days after TROUSSELIER notice of his desire to withdraw.

7.1 EXCHANGE

The exchange goes against a similar item within the limit of the available stock. The exchange shall be processed within a maximum period of 14 days from the date when TROUSSELIER S.A.S.was advised with customer’s decision to withdraw ; this, assuming the item is returned in perfect condition in its original packaging. The customer shall be responsible for the cost of returning the item or items to be exchanged. TROUSSELIER S.A.S. will cover the re-delivery costs.

7.2 REFUND

If the customer chooses to be refunded, TROUSSELIER S.A.S. shall refund the price of the item or items and the delivery costs to the customer within a maximum period of 14 days from the date when TROUSSELIER S.A.S. are informed of the customer’s decision to withdraw, assuming the item is returned in perfect condition in its original packaging. The chosen date shall be the date of the first of these events. The refund shall be made via the same payment method as the one used for the initial transaction.  If a virtual payment card has been used, the refund shall be made by cheque. Charges for returned or refunded items remain at the customer’s.

8. LEGAL WARRANTIES AND AFTER-SALES SERVICE

The sold items fall under the legal compliance warranty provided for by Articles 211-4 et seq. of the French Consumer Code, and from the hidden defects warranty (Articles 1641 et seq. of the French Civil Code). These warranties cover hidden defects and apparent defects from the delivery date. The sole obligation for TROUSSELIER S.A.S. in relation with this warranty is either to replace on a free of charge basis the items identified as defective, or to repair them, with no other service or compensation.

This warranty does not cover damage resulting from the irrelevant use of the item, normal wear, or non-compliance with washing and maintenance instructions. Invoice and delivery bill will be requested to claim for security covering Returned items and after-sales queries must be sent to TROUSSELIER S.A.S’ After-Sales Department 23 avenue des Prés 94260 Fresnes, France.

9. PRIVACY

Your personal data are required to process your order and to communicate with each other.

This information may be given to our partners, especially to carriers.

You have the right to access, modify, rectify and refuse access to the information regarding your personal data in conformity with Law "computer data and liberty" dated Jan 6 1978 modified on august 6 2004 as per

TROUSSELIER SAS declaration near CNIL#2001878 (Data protection act)

10. INTELLECTUAL PROPERTY

All elements of the site TROUSSELIER.fr are and remain the exclusive intellectual property of the company TROUSSELIER SAS. No person is allowed to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple or hypertext link is strictly forbidden without the express written agreement of TROUSSELIER SAS

11. LIMITATION OF LIABILITY

In no event will TROUSSELIER S.A.S. be liable to any party for any direct, indirect, incidental, special, consequential or punitive damages for use of this website including, without limitation, lost profits or revenues, costs of replacement, loss of opportunity, business interruptions, loss of data or damages resulting from any purchase of its products. 

TROUSSELIER S.A.S. does not guarantee or warrant that the site or the information contained on the site are compatible with your systems or will be free of viruses, disabling devices or other code that manifests contaminating or destructive properties. You are responsible for implementing safeguards to protect the security and integrity of your systems.

Finally, TROUSSELIER S.A.S. are not responsible for any delay or consecutive non-execution of goods resulting from a case of force majeure. 

11. COMPETENT JURISDICTION

These general terms and conditions of sale are governed by French law. Any dispute that has not been resolved amicably shall be subject to the jurisdiction of the relevant courts in Creteil or to the court in the effective place of delivery for the customer's order, notwithstanding multiple defendants and/or the introduction of third parties, even in the case of emergency proceedings or emergency or on-demand safeguard proceedings.
